All About Perjury

In a court of law, after swearing under oath, most people expect plaintiffs, defendants, and witnesses to tell the truth and nothing but the truth. Unfortunately, this is not always the case. Perjury, also known as forswearing, is the act of lying or making false statements under oath while in a court of law, or in any sworn statement in writing. Perjury is a criminal offense because the law relies on truthful witness testimony in order to maintain its fairness and credibility. In the United States, a person accused of forswearing can face up to five years in prison.

Trade Secrets Experts - Two Circuits, Two Outcomes

Two recent rulings from federal circuit courts reviewing expert testimony in trade secrets cases reached very different results, with one circuit upholding admission of the testimony and the other finding that the testimony was sufficiently harmful to require a new trial.

Taken together, the two cases shed light on the allowable boundaries for expert testimony in trade secrets litigation.

The most recent ruling, Synergetics v. Hurst, decided February 5th by the 8th U.S. Circuit Court of Appeals, upheld an expert’s testimony on economic damages, despite the appellant’s contention that it was based on incorrect assumptions about the relevant market.

Introduction To .uk Domain Disputes

The .uk registry is the world’s fourth largest (after the .com, .org and .de registries). It is administered by Nominet, a not-for-profit company based in Oxford, England. Nominet acts not just as the .uk registry, but also as the .uk dispute resolution service provider.

Nominet does not use the UDRP for dispute resolution, but has instead created a distinctive system inspired by the UDRP. The substantive rules governing .uk disputes are set out in Nominet’s dispute resolution policy document (referred to below simply as the “Policy”) and its dispute resolution procedure document.

Live On Forever (or Why You Need An Ethical Will)

In the movie “The Bachelor,” starring Rene Zellweger and Chris O’Donnell, a young man’s grandfather had himself videotaped reading his will, in which he directed his grandson would receive his $100 million estate only if he was married by 6:05 p.m. on his 30th birthday. If not, the grandson inherited nothing. The rest of the movie is about the grandson trying to overcome his fear of marriage and getting married on the next day, his 30th birthday. He proposes to 10 women whom he doesn’t love while the song “Hit the Road Jack” plays in the background. But, in the end, his true love comes through and the wedding occurs just in time (and in the money) at 6:05 p.m. The movie closed with the song “Your Love Keeps Lifting Me (Higher and Higher).”

Sec Needs Rules And Regulations Overhaul

The Securities and Exchange Commission or SEC needs a complete overhaul of the rules and regulations. They are hurting the little guy and they are not helping the investor or consumer. With all the massive over disclosure and Sarbanes Oxley rules it is costing corporations millions of dollars each year to comply.

This does not help the investor but rather hurts the investor because those costs must be passed on and that means higher fees and in the case of money managers, it means reduced commissions to brokers and financial planners who manage money. Thus many are leaving the industries. It means lower corporate earnings and less shareholders value, no body wins by the government in extortion fines, the lawyers in lawsuits and accountants, of which there is now an artificial shortage thanks to over regulation.

Can An Internet Search Engine Really Become A Monopoly?

The Federal Trade Commission is still closely watching Microsoft for giving its software users a free Internet Browser and yet it did nothing when AOL attempted to give away free Internet service. Of course, we know that is below cost, "dumping" and cannot possibly be allowed, whereas, the free Microsoft Brower was already paid for in R and D and costs them nothing to give it to you along with whatever Operating System you purchased.

Cell Phones Becoming Serious Driving Hazard

According to statistics, a person will die in a vehicle crash every 12 seconds in the United States. Statistics also show that vehicle crashes are the leading cause of death for Americans age 35 and younger, and 98% of reported accidents involve a single distracted driver.

Distractions include rubbernecking (watching other drivers and accidents), driver fatigue, looking at scenery, passenger- or child-related distractions, adjusting the radio, and cell phone use. In fact, a new study confirms that the reaction time of cell phone users slows dramatically, increasing the risk of accidents and tying up traffic in general.
