Business Method Patents, Part I

Business method patents protect some very important things in your business.

Since the Supreme Court’s decision in 1998 to grant patents based on business methods, the Patent and Trademark Office has been inundated with applications of this type. There is currently a four-year wait for patent application approvals.

Before 1998, it was normally the assumption that a method of doing business could not be patented, and only a few property protections were in place. But in 1998, a landmark case between Signature Financial Group and State Street Bank and Trust, handed down a decision that a patent could be obtained based on a method of doing business. The dispute between these two companies involved a way to calculate concerning mutual funds, and the Supreme Court agreed that a particular method for calculating them could be patented under a business method patent.

The Difference Between Trade Secrets And Trademarks

Some people get confused between trade secrets and trademarks. A trademark is something that is publicly recognized and known as being officially associated with a particular company. In contrast a trade secret can be a much more broad definition and by its very name is not made public.

According to the laws in most states, any device, pattern, formula, idea, or collection of information that gives the owner an advantage in the marketplace and is protected by the owner in a way that shows that it can be reasonably expected to keep their competitors or the public from finding out about it without stealing it is considered a trade secret.

Tn Visa (tn-1) For Canadians/mexicans To Work In The United States

TN a special United States immigration status applicable only to the citizens of Canada and Mexico. The TN status is a result of the 1994 North American Free Trade Agreement (NAFTA) where Canadian and Mexican citizens were granted the opportunity to work in the US, although the fields were defined. Some aspects of the TN visa make it similar to the H1-B visa although the TN has some added unique features. In fact, TN status holders can work for up to a year at a time although it can be renewed indefinitely in one-year increments. The occupations defined for TN status holders are also quite a bit more limited than for the H-1B visa.
